Why not "Come Sail Away" ?

I was just curious as to why the DVDs (Arch Allies, CYO) don't have "Come Sail Away" on them. I figured this was a staple song for them and the fans eat it up. Is there something I'm not aware of regarding this?

styx cannot use any songs solely penned by DDY on a live album or dvd (mechanical licensing rights) but they can perform them in concert.

Its really an issue of not using without consent when it comes to the specific rights in question. I believe that they still played the song at CYO but its just not on the DVD presumably because DDY would never consent. Apparently, Steve Windwood's song was played live but he did not provide his consent for it to be on the DVD.

in this case its more of not getting the right rate to pay the writer, or not wanting to pay the writer, tommy/jy would not want to include ddy in the royalties.

Actually, in the case of 'One Wth Everything' it's a matter of, part of their lawsuit settlement with Dennis states that they cannot film Gowan doing Dennis songs for release anymore. It was one of Dennis' bargaining points.

Too bad they can't prevent Gowan from singing any of DDY's songs too. Gowan doing "Come Sail Away" reminds me of Roseanne Barr doing the National Anthem.

Funny, I always thought Come Sail Away was a group effort. For example, wasn't the Chorus melody written by Tommy? And some other part written by the Blue Falcon's boy JY?

I've heard many times that it is the settlement of the lawsuit that prevents it now, as opposed to some of the other versions prior. That may have been Dennis' objection - the fact that he was gone, but his songs were still promoting the new group in new live releases. That would be my guess, at any rate. But I spoke to someone at the Ryman show a couple of years ago and he mentioned that they were filming, but could not film Gowan doing Dennis songs for release because of the lawsuit settlement.
