On an unrelated note, is anyone else having any problems with this site? Everytime I try to get on via my computer, I am prevented by a screen that says there is malware here. I've tried using Chrome and Firefox. The only way I can get on is through my Kindle, which is a bit of a pain in the ass. Any suggestions?

First time he's publicly admitted what many of us knew/suspected - they work for DDY. He gets a piece of all the action.

No, Dennis getting money is not part of the lawsuit. He gets money because they play his songs. Just as ZZ Top was paid when Styx used to play Tush. When they play Walrus they have to pay whoever owns the songs. Manic Depression? Pay the Hendrix Estate. It's not part of the lawsuit, just how it works.... And the gag order never expires. Just ask Huey Lewis. He spoke about his lawsuit with Ray Parker Jr on Behind The Music and Ray saw it and sued him because he discussed the terms of the suit (New Drug vs Ghostbusters).

Sorry Mike but you are incorrect about this. Dennis does in fact gets a percentage of everythng they bring in. It was part of the settlement. And I can say this because JY has opened his mouth.

Honestly, whether DDY does or not get a cut doesn't really matter. The whole thing was settled out of court and whether or not a gag is still in effect - who cares? Let's say they are paying DDY x% per show or whatever. They still have to pay him the royalties for the songs on top of that cut UNLESS the deal allows them to play the songs like CSA royalty-free ... which I doubt.

Sure it matters - it means that he is technically still an owner of the trademark - at least financially. And it goes a long way toward explaining the continued bitterness that JY feels toward DDY.

Perry still has some editorial control and has been behind the scenes with a number of compilations and DVD of footage he's been in. DDY has had no control over any compilations even ones featuring songs from his era - see "Rockers", "Gold," and any of the other variations out there. Its too bad DDY wasn't able to retain some of that - you might not have had some of the embarassments to hit the market - then again if it is about the almighty dollar, he might still have gone along.

The long and short of it is that for the majority of his life, DDY put his blood, sweat and tears into the success of the band. Therefore he deserves what he is getting regardless of what the rest of the member's personal feelings about it. Without out him there would not have been this band. Some will argue that they are doing just fine without him but, this of course is after all the hard work and foundation that Dennis was major part of has been built.

why would it be a a surprise or a statement of "victory" for JY to acknowledge that DDY gets a piece of the action? it makes perfect sense to how a dispute like this would be settled.

nobody ever claimed that DDY wasnt a HUGE part of even the primary part of building STYX: the brand.

all parties involved knew that going forward that holding the name STYX would equal more opportunities and chances to be in the spotlight and basically continue your career with a decent paycheck vs. going out as DDY or as Tommy & JY. Those names dont sell and if they did then DDY wouldnt bother to add the verbiage of "the music of styx" in his concert billings.

Being legally allowed to call your band STYX opens the door to touring with def leppard, journey, reo speedwagon, foreigner, kansas, bad company, ted nugent and to make appearances at the super bowl and at major sporting events. This is in addition to the standard circuit of casinos and ribfests and fairs.

being "solo" as DDY is now, even with the "playing the music of STYX" still only allows him the touring chances of playing on his own in small theaters and ribfests and fairs.

He's making on average about 25-35k every time he walks out on stage and pays his expenses and band mates out of that.

STYX is making 50-75k every time that play and pay the same bills DDY does but play about 3x the amount of shows DDY does in a year.

If STYX averages 60k per show and plays 110 shows per year they are still grossing 6.6 million dollars per year and those opportunities come along mostly because of the name STYX.

If DDY averages playing about 30 shows per year and averages 30k per show then he is grossing about $900,000 per year. and dont think for a minute that if he could get on one of these package tours that is roughly 40-50 dates as maybe the middle act of a three act bill and get paid about 50k per night and "expose" his new band that he wouldnt JUMP ALL OVER IT!!!! he would, not only for the money but just to hopefully regain more popularity that Tommy and JY have running around the country with his "Band" and "Brand".

so giving DDY a "piece of the action" to still be able to carry on with the name of the "brand" that you helped build and that still allows you to be in a multi-million dollar business is a no-brainer on their part and seems to be a standard way to settle these things.
