Okay, let me get this straight.

You created this work of art. You brought it to a AStyx show. A couple of members of the band, namely Sucherman and Burtnik autograph it. You took it home.

A year later, Universal Music Group releases a record with a similar cover.

Does anyone believe it's possible that Todd & Glenn went running back to the art department to describe your piece? Here's another one: Does anyone believe it's possible that Todd & Glenn have a THING to say about the covers of Styx albums? How about a compilation of music that they had nothing (or little) to do with? And I believe Burtnik's been out of the band for 6 months (almost a year?) now.

I'm not trying to take a thing away from your art work. Good job, in fact! I just got a wiled up when I read the "don't take this lying down, go to a lawyer" type posts.

What a world.

I'm gonna go to a lawyer about this board. It hurts me.

Sue everybody!

My advice on this to you is to contact Dennis through The Crib on his website. Since it sounded like Dennis knew nothing about this release and he will reap some of the benefits from its sales, I bet he would like to know where the cover design might have come from. Dennis or Suzanne may be able to help you on this matter.

I believe somebody saw my work and took liberties with it to produce the new cd cover. I don't think I ever said anyone in the band was actually responsible. I did say the band saw the artwork and they liked it back in 2001. Nothing more, nothing less. I was just trying to find out before it was released who did the cover and did they in fact know about my piece of artwork. Being I can't hold of the band to inquire about the cover everything is pure speculation. The band might or might not have approval on any artwork, especially for a comp to a record company that they no longer have a contract to.

I have tried to do this in a light-hearted way and not point fingers at anyone. The last thing I would ever want to do is piss-off the band.

Pat,

I am a card carrying Styxworld.com Lounge member. I am going to see them in San Antonio May 19, and cant wait. I posted your claim over on their message board. I'm not Yogi over there. I did it very tastefully saying you just wanted to know where the artwork & cover design for the new Come Sail Away Styx Anthology came from. The designs look similiar to me. I know Tommy visits the lounge and chat rooms over there often. Hopefully, you will get some feedback. I still think you should contact Dennis about this too.

I wouldn't necessarily assume that the guys have a whole lot of input at what is happening through the Universal/A&M releases.

Nice to see that Adam has responded in his typical "enthusiastic" style, but I may have to back him up a little bit here. While I agree that the Avatar and the Album cover resemble each other, they are dissimilar enough that I don't think there is any real legal angle here, not that I thought Pat was going to go there anyhow.

Adam did have a point. Celebrities do indeed have stuff thrust at them all the time. Scripts, CD's, Artwork and all sorts of other things. Just go to any fansite that has a multimedia section and you'll usually find a plethora of fan art done in a fashion like the avatar.

Pat, maybe a pat (no pun intended) on the back would be nice, but you did get to meet the band and have them sign your artwork. Maybe that and the recognition you get here will be enough.

I just want to know if it was based in any way off my design. One way or another. I know I don't really have any legal rights or anything. Like I said before, it was changed or is different than mine enough ways probably that they (Universal, the band, whoever came up with the idea) are covered. I never said I would go to a lawyer or anything, other people have said that.

I know people do artwork like mine all the time and have the band sign it. I don't want this to change. I have been very fortunate to have Styx sign 2 pieces of artwork. The other is a painting I did in 89 of Dennis and half his face is a Roboto! It is not very good but still the band was awesome enough to sign it on the Edge tour and I took it on the Return To Paradise Tour to get Tommy to sign it. The thing about my cover artwork is it was done in 1999 and now it is 2004 and something similar in concept/design is being used for a real cover.

There is no gray area here. PT has a case. Not "in my opinion" but a real legit. case. There is no denying that ALL of the band saw the work. There is no denying that their Anthology cover is VERRRY close. So again whether or not there is a legit. case is a dead issue. It IS. The only question is "What will the judge decide...".
Have a great weekend ya'll!!

I saw a TV commercial for the new Anthology. It was at least 2 minutes long and had a toll free number to order the CD.

Interesting.......were you watching VH1 Classic ? I cant imagine the record company has a large promotional budget. I'd be interested in knowing the what channel and what time info on that.

I heard from someone today that the Anthology cover is not based in any way on my initial design. It is just a "coincidence that both designs contain a large logo and an element of water." I have no proof to doubt the guy or anything so I guess it just sucks for me.

Thanks for all the kind words on my work. It is much appreciated.

Saw the Anthology on prominent display in the little Wal-Mart near where I live. Not as cheap as online, of course.

Can anyone give us a little summary of what's in the book?

Thanks.

Thanks, spaceace.

So much for the "rare" and "rarely seen" photos I heard about. Well, maybe there were a few included.

the book to me appeared to be very generic. An old picture of glen from eoc days and the current pic of the band in the red hallway. Interestingly enough, with that picture, they don't name the members of the band.

Interesting twists were really the cover itself. Inside was a pic of the water seen on the front as if a rock had just been dropped in it and the back has the back of a kids head looking at the logo and mountains from the othe side of the mountains.
